Quiz Quix Official Rules

Introduction

1. The Rules. These Quiz Quix Official Rules (the “Official Rules”) are the standard terms and conditions applicable to contests administered by Vantage Point Media, LLC., d/b/a AndNowUKnow.com whose address is 2005 Capitol Avenue, Sacramento, CA 95811, telephone no. (855) 466-3038, email: [email protected] (the “Sponsor”).

2. Incorporated Terms. These Official Rules incorporate the AndNowUKnow.com Privacy Policy (the “Privacy Policy”) as well as the AndNowUKnow.com Website Terms of Service (the “Terms of Service”).

3. Acceptance. Participation in the Quiz Quix (the “Quiz”), constitutes acceptance of these Official Rules, the Privacy Policy, the Terms of Service, and the decisions of the Sponsor, which are final in all matters relating to the Quiz.

Eligibility

1. Free. NO PURCHASE NECESSARY TO WIN. VOID IN WHOLE OR IN PART WHERE PROHIBITED BY LAW.

2. Eligibility Requirements. To be eligible to participate in the Quiz, all participants (each a “Participant”) must be:

   1. a registered subscriber of AndNowUKnow.com;

   2. over the age of 18 (with valid driver’s license and social security number); and

   3. aa legal resident of the United States or Canada (with the exception of Quebec). .

3. Exclusions. Employees of the Sponsor, their respective parents, subsidiaries, affiliates, advertising and promotion agencies and their family/household members (defined as parents, spouse, children, siblings, grandparents) are not eligible to participate.

4. Limit one entry per person, per subscriber email address, per Quiz. More than one entry from any person or e-mail address will void all entries from that person or email address. Participants must have a valid email address registered in their individual name.

5. Applicable Regulations. All federal, state/provincial and/or local rules and regulations apply.

How to Enter

1. Contest Period:  Each Participant shall access the Quiz through the AndNowUKnow.com website, and fill in all required “login” information prior to participating in the Quiz online.  Each Quiz begins at 12:00 a.m. Pacific Time on the date of posting on AndNowUKnow.com and ends at 11:59:59 a.m. Pacific Time the same day, unless otherwise indicated in the AndNowUKnow.com newsletter or website.    

2. Timing.  The Sponsor is the official time-keeper for the Quiz, of which all decisions are final. The timing aspect of the Quiz is based on the time recorded between when a question is displayed and when it is answered by a Participant during a Quiz.  The time between each question, i.e., the time it takes the question page to load, is not counted toward a Participant’s quiz time or score. Time is measured in microseconds. 1000 microseconds = 1 millisecond.  Once a Quiz is started, timing begins and the Participant cannot start over, go back, or request a new Quiz. Each Participant may take each Quiz only once.

3. Quiz Submissions. The Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic, including, but not limited to, bugs or malfunctions, that Participant may encounter when participating in the Quiz.  Proof of submission will not be deemed to be proof of receipt by the Sponsor. Participants can only use one (1) subscriber email address for identification and to claim prize(s). Participants are prohibited from using multiple subscriber email addresses to participate in Quiz sessions. Participants found to be in violation of this rule will be banned from participation in any future Quiz.

4. Scoring: Each Participant’s Score on the Quiz is based on the total time used to complete the Quiz session and the number of correctly answered Quiz questions. Participants with zero correct answers will make the leaderboard and will be awarded 1,250 ‘points’, minus the total time duration, in seconds, multiplied by 0.25. If the duration exceeds the initial amount awarded, the user will receive 0 total points (1250 - (duration * 0.25)) or (0). Otherwise, Participants are awarded 2,500 points for each question answered correctly minus the session duration, in seconds, multiplied by 2.5 ((score * 2500) - (duration * 2.50)).

5. Winner Selection: The Participant(s) with the highest score on a Quiz will be the Winner(s). In the event that multiple Participants obtain identical high scores, Winners will be randomly selected by the Sponsor from the pool of the highest scoring Participants. Winners will be announced within seven (7) days of the completion of each Quiz. The announcement will be shown in the body of the AndNowUKnow.com newsletter and on the website.  The Winner(s) will also be notified of their win by email using the subscriber email address used to participate in the Quiz.

6. Claiming Prizes. In order to claim a Prize, Winner(s) will be required to execute an Affidavit of Eligibility, a Liability Release and where lawful, a Publicity Release within seven (7) calendar days of prize notification.  If the Winner(s) cannot be contacted within seven (7) calendar days of first notification attempt, if prize or prize notification is returned as undeliverable, if the Winner rejects his/her prize or in the event of noncompliance with these Quiz rules and requirements, such prize will be forfeited and an alternate Winner will be selected from all remaining eligible participants. Upon prize forfeiture, no compensation will be given.

7. Prize Limit. Limit of one prize per Participant.

8. Prizes: The approximate value of each prize will be disclosed as Quizzes are announced. Not all Quizzes will  offer a cash prize to the Winner(s).  Quizzes with cash prizes will be clearly identified in the AndNowUKnow.com newsletter and on the AndNowUKnow.com website.  The Winner of a Cash Quiz will receive a  USD Visa gift card via Certified Mail. Odds of winning depend on the number of correctly answered questions, the time taken to complete each question, and the number of Participants.  The number of Participants will vary for each Quiz and Sponsor cannot predict the total number of Participants for any Quiz.   A verified physical mailing address must be supplied by the Winner(s) to the Sponsor in order for the Winner(s) to receive a prize. The Sponsor makes no warranties with regard to the prizes. Prizes are not transferable. No substitutions of prize allowed by Winner(s), but Sponsor reserves the right to substitute, in its sole discretion, a prize of equal or greater value due to prize unavailability. Prizes are not redeemable by Winner for cash value. All taxes, fees and surcharges on prizes are the sole responsibility of winner. Each Winner hereby irrevocably waives the right to assert as a cost of receiving any prize any and all costs of verification and redemption to redeem such prize, if any, and any liability which might arise from redeeming or seeking to redeem such prize.

Conditions of Participation

1. Personal Information and Use of Data.  Sponsor will be collecting personal data about participants online. By participating in the Quiz, Participants hereby agree to Sponsor’s collection and usage of their personal information pursuant to the website Privacy Policy. All Quiz responses, sessions and scores become the sole property of the Sponsor and none will be returned.

2. Release. Entry in the Quiz constitutes permission to the Sponsor to use Winner’s name, picture, image and likeness for purposes of trade, publicity or promotion in all media without additional compensation except where prohibited by law.

3. Limitation of Liability. BY PARTICIPATING IN THE QUIZ, PARTICIPANTS AGREE TO RELEASE AND HOLD HARMLESS SPONSOR, AND THEIR RESPECTIVE PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTIONS AGENCIES, PARTNERS, REPRESENTATIVES, AGENTS, SUCCESSORS, ASSIGNS, EMPLOYEES, OFFICERS AND DIRECTORS, FROM ANY AND ALL LIABILITY, FOR LOSS, HARM, DAMAGE, INJURY, COST OR EXPENSE WHATSOEVER INCLUDING WITHOUT LIMITATION, PROPERTY DAMAGE, PERSONAL INJURY AND/OR DEATH WHICH MAY OCCUR IN CONNECTION WITH, PREPARATION FOR, TRAVEL TO, OR PARTICIPATION IN QUIZZES, OR POSSESSION, ACCEPTANCE AND/OR USE OR MISUSE OF PRIZE OR PARTICIPATION IN ANY QUIZ-RELATED ACTIVITY AND FOR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY AND MERCHANDISE DELIVERY.

General

1. Law. The Quiz is governed by the laws of the State of California.  

2. Disputes. In the event of a dispute, queries made via Internet will be deemed made by the authorized account holder of the e-mail address submitted at the time of participation. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning Quiz session.

3. Disputes Resolved Individually. Any and all disputes, claims and causes of action arising out of or connected with the Quiz, or any prize awarded, shall be resolved individually, without resort to any form of class action.

4. Technical Failure. If for any reason the Quiz is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of the Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Quiz, the Sponsor reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Quiz. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Quiz.

5. Abuse of Quiz. The Sponsor may prohibit a Participant from participating in the Quiz or winning a prize if, in its sole discretion, it determines that said Participant is attempting to undermine the legitimate operation of the Quiz by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs or web “bots”) or intending to annoy, abuse, threaten or harass any other entrants or the Sponsor’s representatives.

6. Force Majeure. The Sponsor is not responsible if Quizzes cannot take place or if [any] prize cannot be awarded due to delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism.

7. Termination and Changes to Official Rules. The Sponsor reserves the right, in their sole discretion, to terminate any Quiz, in whole or in party, and/or to suspend, cancel or modify these Rules as necessary for any reason or as required by applicable law without prior notice.
